This privacy policy describes the personal data collected or generated when you interact with Gymhawk web pages, Gymhawk digital experiences and mobile applications, store events, or any of our other products or services, all of which are part of the Gymhawk Platform. This Policy describes the types of personal data collected and how it is used, shared, and protected. It also explains the options you have regarding your personal data and how you can contact us.

Who is responsible for processing your personal data?

Peregrina Motors Company S.A.S de C.V. (CLL Dolores Guerrero 113-B, CTM Culhuacán sección XA, 04909, Coyoacán, CDMX) is responsible for processing data on our Platforms.

In this privacy policy, the terms "Gymhawk", "our", "ours" or "us" refer to the applicable Gymhawk company(ies).

What personal data do we collect and when?

To provide you with the products or services you request, we will ask for certain personal data. For example, when you make purchases, contact our customer service, request to receive communications, create an account, participate in our events or contests, or use our Platform. Additionally, when you request specific services in a store, we may ask you to log in to provide you with services associated with your account. This personal data includes your:

Contact information, including name, email, phone number, and shipping and billing address
Login and account information, including username, password, and unique user ID
Personal data including gender, hometown, date of birth, and purchase history
Payment or credit card information
Images, photos, and videos
Data on physical characteristics, including weight, height, and body measurements (such as estimated stride and shoe/foot measurements or bra size)
Personal preferences including your wish list, as well as marketing and cookie preferences.

We use additional personal data to enable particular functions within our Platform. For example, we request access to your phone's geolocation data to record your running route, your contacts so you can interact with your friends, your calendar to schedule a training plan, or your social network credentials to be able to post content from an App to a social network. This personal data includes your:

Movement data from your device's accelerometer
Photos, contacts, and calendar information
Sensor data, including heart rate and location data (GPS)
Social media information, including credentials and any information from your public posts about Nike or your communications with us

When interacting with our Platform, some data is automatically collected and shared with Gymhawk through your device or browser.

Such data includes:

Device identifiers, call status, network access, storage information, and battery information
Cookies, IP addresses, referrer headers, data identifying your web browser and version, visit counters and web tags, and tags and interactions with our Platform.

Children

We comply with local laws and do not allow children to register on our Platform if they have not reached the minimum legal age required in their country of residence. We will request parental consent for minors participating in Gymhawk experiences and events.

Tools to manage the personal data we collect

When you use our Platform, we also inform you about our collection and use through standard permissions in e-commerce stores and apps, mobile operating systems, and in the Platform experience. Where necessary, we will also ask for your consent.

In many cases, your web browser or mobile device platform will provide additional tools that allow you to control when your device collects or shares certain categories of information. For example, your mobile device or web browser may offer tools that allow you to manage the use of cookies or location sharing. We encourage you to familiarize yourself with and use the tools available on your devices.

Why and how do we use (process) your personal data?

To provide the features of the Platform and services you request

When you use our Platform, we will use your data to provide you with the product or service you have selected. For example, if you make a purchase on gymhawk.mx, or participate in an event or promotion, we will use the contact information you provide to communicate with you about the purchase, event, or promotion. If you contact our customer service, we will use information about you, such as delivery or payment information, or the product you purchased, in order to help you resolve a problem or question.

To communicate information about our products, services, events, and for other promotional purposes

When you give your consent, we will send you advertising communications and news about Gymhawk products, services, events, and other promotions that may be of interest to you. You can unsubscribe at any time after giving your consent.

Direct marketing

If you are a current Gymhawk customer (for example, if you have placed an order with us), we may use the email address provided to send you marketing communications about similar Gymhawk products or services, unless you have opted out. In other cases, we will ask for your consent to send you marketing information about Gymhawk products, services, events, and promotions.

Personalization

We may use the information you provide to us, as well as information from other Gymhawk products or services - such as your use of the Gymhawk Platform, your visits or purchases made in Gymhawk stores, your participation in Gymhawk events and contests (possibly through other Gymhawk group companies) - to personalize communications about products and services that may be of interest to you. In doing so, we may combine the information you share with us with information we generate about your online activity, including internal analysis and observations.

To operate, improve, and maintain our business, products, and services

We may use the data you provide to us to operate our business. For example, when you make a purchase, we may use that information for accounting, auditing, and other internal functions. We may use data about how you use our products and services to improve your user experience and to help us diagnose technical and service issues, as well as to administer our Platform.

To protect our property or safety or our own or third-party rights

We may also use data about how you use our Platform to prevent, detect, or investigate fraud, abuse, illegal uses, and breaches of our Terms of Use and our Platform's policies, and to comply with court orders, governmental requests, or applicable laws.

We use data about how our visitors use our Platform and services to understand customer behavior or preferences. For example, we may use information about how visitors to gymhawk search for and find products to better understand the different ways to organize and present product offerings in our store.

Legal Basis

To process your personal data, we rely on certain legal bases, depending on how you interact with our Platform and the applicable laws.

When you purchase Gymhawk products from the platform, we need your personal data to fulfill our contract with you. For example, we need payment information and contact details to deliver your order.

Sharing your personal data

Gymhawk Sharing

Gymhawk shares your personal data with:

Gymhawk group companies for the purposes and under the conditions described above
Service providers who process personal data on behalf of Gymhawk, for example, to process credit cards and payments, shipping and deliveries, manage and service our data, distribute emails, research and analyze, manage brand and product promotions, as well as administer certain services and functions. When we use the services of providers, we enter into agreements with them requiring them to implement appropriate technical and organizational measures to protect your personal data.
Other third parties to the extent necessary to: (i) comply with a government request, court order, or applicable law; (ii) prevent illegal uses of our Platform or violations of the Terms of Use and our Platform's policies; (iii) defend ourselves against third-party claims; and (iv) assist in the prevention or investigation of fraud (e.g., counterfeiting)
External providers of targeted advertising who provide us with personalized advertising services. We use such services to match the information we have with personal data in those providers' databases to create personalized audiences and tailor advertising to your interests on the Internet, including social networks, as permitted by applicable law. You can opt out of personalized advertising and exclude yourself from personalized audiences using the relevant settings on our Platform.
Any other third party when you have given consent.

We may also transfer the personal data we hold about you in the event that we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution, or liquidation).

Your Sharing

When you use certain social functionalities on our Platform, you can create a public profile that may include information such as your username, profile picture, and hometown. You can also share content with your friends or the public, including information about your Gymhawk activity. We encourage you to use the tools we provide to manage Gymhawk social sharing to control the information you make available through Nike's social functionalities.

Protection and management of your personal data

Encryption and security

We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the security of your personal data.

International data transfers

The personal data we collect or generate (process) in the context of our Platform will be stored in the U.S. and other countries. Some of the data recipients with whom Gymhawk shares your personal data may be located in countries other than the country where your personal data was originally collected. The laws of those countries may not offer the same level of data protection as the country where you initially provided your data. However, when we transfer your personal data to recipients in other countries, including the U.S., we will protect that personal data as described in this Policy and in accordance with applicable law.

We use a variety of measures to ensure that your personal data, when transferred, receives adequate protection in accordance with data protection standards. When personal data is transferred within Gymhawk, we use an intragroup data transfer agreement.

Retention of your data

Your personal information will be retained for as long as necessary to carry out the purposes set out in this privacy policy (unless a longer retention period is required by applicable law). Generally, this means that we will retain your personal data for as long as you maintain your Gymhawk account. For personal data related to product purchases, we retain it longer to comply with legal obligations (such as tax and sales laws and for warranty purposes).

Cookies and Tracking Pixels

Gymhawk receives and records information, which may include personal data, from your browser when you use our Platform. We use a variety of methods, such as cookies and tracking pixels ('Pixel Tags') to collect this information, which may include your (i) IP address; (ii) unique cookie identifier, cookie information, and information about whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type, and language; (v) operating system and system settings; (vi) country and time zone; (vii) previously visited web pages; (viii) information about your interaction with our Platform, such as click-through behavior, purchases, and indicated preferences; and (ix) access times and referring URLs.

Third parties may also collect information through the Platform using third-party cookies, plug-ins, and widgets. These third parties collect data directly from your web browser, and the processing of this data is subject to their own privacy policies.

We use cookies and tracking pixels to track how our customers use the Platform and to understand our customers' preferences (such as country and language choices). This allows us to provide services to our customers and improve their online experience. We also use cookies and tracking pixels to obtain aggregate data about Platform traffic and interaction, in order to identify trends and obtain statistics so that we can improve our Platform. Generally, there are three categories of cookies used on our Web Pages:

Functional: These cookies are necessary for the basic functioning of the Website and, therefore, are always enabled. These include cookies that allow you to be remembered while exploring our Platform in a single session or, if requested, from session to session. They help make the shopping and payment process possible, as well as assist with security and regulatory compliance issues.

You can also choose to have your computer warn you each time a cookie is sent, or you can choose to disable all cookies. This is done through your browser settings on each browser and device you use. Each browser is a little different, so look in your browser's Help menu to learn the correct way to modify your cookies. If you disable cookies, you may not have access to many features that make our Platform more efficient, and therefore, some of our services will not function properly. Similarly, you can adjust your mobile device's advertising preferences at the device level. Use of the gymhawk platform with third-party products and services

Our Platform allows you to interact with a wide variety of digital products and services. For example, our Platform can integrate with third-party activity trackers, social media, music streaming services, and other digital services.

If you choose to connect your Gymhawk account with a third-party device or account, your privacy rights on third-party platforms will be governed by their respective policies. For example, if you choose to share your Gymhawk activity on third-party social media platforms, the policies of those platforms govern the data residing there.

Our Platform may provide links to other websites and apps (from third parties) for your convenience or information. Linked websites and apps have their own privacy notices or policies, which we strongly recommend you review. To the extent that linked websites and apps are not owned or controlled by us, we are not responsible for their content, your use of the websites or apps, or the privacy practices of websites or apps.

Changes to our privacy policy

Applicable law and our practices change over time. If we decide to update our Policy, we will post the changes on our Platform. If we materially change the way we process personal data, we will provide you with prior notice or, where legally required, request your consent before implementing such changes.
