This Privacy Policy describes the personal data collected or generated when you interact with Gymhawk websites, Gymhawk digital experiences and mobile applications, in-store events, or any of our other products or services, all of which are part of the Gymhawk Platform. This Policy describes the types of personal data collected and how it is used, shared, and protected. It also explains the choices you have regarding your personal data and how you can contact us.

Who is responsible for the processing of your personal data?

In this privacy policy, the terms “Gymhawk”, “our”, “we” or “us” refer to the applicable Gymhawk company(ies).

What personal data do we collect and when?

In order to provide you with the products or services you request, we will ask you for certain personal data. For example, when you make purchases, contact our customer services, request to receive communications, create an account, participate in our events or contests, or use our Platform. Additionally, when you request specific services in a store, we may ask you to log in to provide you with services that are associated with your account. This personal data includes your:

Access and account information, including username, password, and unique user ID
Personal data including gender, hometown, date of birth and purchase history
Payment or credit card information
Images, photos and videos

For example, we request access to your phone's geolocation data to record your running route, your contacts so you can interact with your friends, your calendar to schedule a training plan, or your social network credentials so you can post content from an App to a social network. Accelerometer motion data from your device
Photos, contacts and calendar information
Sensor data, including heart rate and location data (GPS)
Social media information, including credentials and any information from your public posts about Nike or your communications with us

When you interact with our Platform, some data is automatically collected and shared with Gymhawk through your device or browser.

Device identifiers, call status, network access, storage information, and battery information
Cookies, IP addresses, referrer headers, data that identifies your web browser and version, web beacons and tags, and tags and interactions with our Platform.

Children

We comply with local laws and do not allow children to register on our Platform if they are under the minimum legal age required in the country in which they reside. We will seek parental consent for minors participating in Gymhawk experiences and events.

Tools to manage the personal data we collect

When you use our Platform, we also inform you about our collection and use through standard permissions in e-commerce stores and apps, mobile operating systems, and in the Platform experience. Where necessary, we will also ask for your consent.

In many cases, your web browser or mobile device platform will provide additional tools that allow you to control when your device collects or shares certain categories of information. For example, your mobile device or web browser may offer you tools that allow you to manage the use of cookies or location sharing. To provide the platform functions and services you request

When you use our Platform, we will use your data to provide you with the product or service you have selected. For example, if you make a purchase on gymhawk.mx, or participate in an event or promotion, we will use the contact information you provide to communicate with you about the purchase, event or promotion. If you are an existing Gymhawk customer (for example, if you have placed an order with us), we may use the email address you have provided to send you marketing communications about similar Gymhawk products or services, unless you have opted out. In other cases, we will ask for your consent to send you marketing information about Gymhawk products, services, events and promotions.

We may use the information you provide to us, as well as information about other Gymhawk products or services - such as your use of the Gymhawk Platform, your visits to or purchases made at Gymhawk stores, your participation in Gymhawk events and competitions (possibly through other Gymhawk group companies) - to personalise communications about products and services that may be of interest to you. In doing so, we may combine the information you share with information we generate about your online activity, including internal analytics and observations.

To operate, improve and maintain our business, products and services

We may use the data you provide to us to operate our business. For example, when you make a purchase, we may use that information for accounting, auditing, and other internal functions. Legal Basis

Gymhawk Exchange

Gymhawk shares your personal data with:

Gymhawk group companies for the purposes and under the conditions described above
Service providers who process personal data on Gymhawk's behalf, for example to process credit cards and payments, shipping and deliveries, manage and service our data, distribute emails, research and analysis, manage brand and product promotions, and administer certain services and features. When we use the services of such providers, we will enter into agreements with them requiring them to implement appropriate technical and organisational measures to protect your personal data.
Other third parties to the extent necessary to: (i) comply with a government request, court order, or applicable law; (ii) prevent illegal uses of our Platform or violations of our Platform Terms of Use and policies; (iii) defend ourselves against third party claims; and (iv) assist in the prevention or investigation of fraud (e.g., counterfeiting).
Third-party targeted advertising vendors who provide us with personalized advertising services. We use such services to match information held by us with personal data in those vendors' databases to create custom audiences and tailor advertising to your interests across the Internet, including social media, as permitted by applicable law. You may opt out of personalized advertising and opt out of custom audiences using the relevant settings on our Platform.
To any other third party where you have given consent.

We may also transfer personal data we hold about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

Your Exchange

When you use certain social features on our Platform, you may create a public profile that may include information such as your username, profile picture, and hometown. You may also share content with your friends or audience, including information about your Gymhawk activity. We encourage you to use the tools we provide to manage Gymhawk social sharing to control the information you make available through Nike's social features.

Encryption and security

We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the security of your personal data.

International data transfers

The personal data we collect or generate (process) in the context of our Platform will be stored in the US and other countries. Some of the data recipients with whom Gymhawk shares your personal data may be located in countries other than the country in which your personal data was originally collected. The laws in those countries may not offer the same level of data protection as the country in which you initially provided your data. However, when we transfer your personal data to recipients in other countries, including the US, we will protect that personal data as described in this Policy and in accordance with applicable law.

We use a variety of measures to ensure that your personal data is adequately protected when transferred in accordance with data protection regulations. When transferring personal data within Gymhawk, we use an intra-group data transfer agreement.

Conservation of your data

Your personal information will be retained for as long as necessary to carry out the purposes set out in this privacy policy (unless a longer retention period is required by applicable law). Generally speaking, this means that we will retain your personal data for as long as you maintain your Gymhawk account. For personal data relating to product purchases, we retain it for longer to comply with legal obligations (such as tax and sales laws and for warranty purposes).

Cookies and tracking pixels

Gymhawk receives and records information, which may include Personal Data, from your browser when you use our Platform. We use a variety of methods, such as cookies and pixel tags, to collect this information, which may include your (i) IP address; (ii) unique cookie identifier, cookie information, and information about whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type and language; (v) operating system and system settings; (vi) country and time zone; (vii) previously visited web pages; (viii) information about your interaction with our Platform, such as click behavior, purchases, and indicated preferences; and (ix) access times and referring URLs.

Third parties may also collect information through the Platform using third-party cookies, plug-ins and widgets. These third parties collect data directly from your web browser and the processing of this data is subject to their own privacy policies.

We use cookies and tracking pixels to track our customers' use of the Platform and to understand our customers' preferences (such as country and language choices). This allows us to provide services to our customers and improve their online experience. We also use cookies and tracking pixels to obtain aggregate data about Platform traffic and interaction in order to identify trends and obtain statistics so that we can improve our Platform. There are generally three categories of cookies used on our Websites:

Functional: These cookies are required for the basic functionality of the Website and are therefore always enabled. Each browser is a little different, so look in the Help menu of your browser to learn the correct way to modify your cookies. If you turn off cookies, you may not have access to many features that make our Platform more efficient and therefore some of our services will not function properly. Similarly, you can adjust your advertising preferences on your mobile device at the device level. To adjust your advertising preferences on Android, visit Settings > Google > Ads > Opt Out of Ad Personalization.

Using the Gymhawk Platform with Third Party Products and Services

Our Platform allows you to interact with a wide variety of digital products and services. For example, our Platform may integrate with third-party activity tracking devices, social networks, music streaming services, and other digital services.

If you choose to connect your Gymhawk account to a third-party device or account, your privacy rights on third-party platforms will be governed by their respective policies. For example, if you choose to share your Gymhawk activity on third-party social media platforms, the policies of those platforms govern the data that resides there.

Our Platform may provide links to other websites and apps (of third parties) for your convenience or information. Linked websites and apps have their own privacy notices or policies, which we strongly recommend you review. To the extent that linked websites and apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of any websites or apps.

Changes to our privacy policy

Applicable law and our practices change over time. If we decide to update our Policy, we will post the changes on our Platform. If we materially change the way we treat personal data, we will provide you with advance notice or, where legally required, request your consent before making such changes.
